Nanny Nook Curacao ("the Platform," "we," "us," or "our") operates as an online marketplace that connects families, organizations, companies, and individuals seeking household help ("Employers") with individuals offering their services as nannies, maids, cleaners, cooks, helpers, and other household professionals ("Workers", "Helpers", "Cleaners", "Nannies", "Cooks", "All Round Helpers").

We are NOT an employment agency. We do not:

• Employ or hire Helpers on behalf of Employers
• Act as an employer or sponsor for Helpers
• Manage, supervise, or control employment relationships
• Provide guarantees about Helpers' qualifications, experience, or performance
• Participate in salary negotiations, contracts, or employment terms

2. User Responsibilities

For Employers (Families, Organizations, Companies, or Individuals):

• You are solely responsible for conducting due diligence, interviews, and background checks
• You must verify Helper credentials, references, and legal work authorization
• You are responsible for all visa sponsorship, work permits, and legal documentation
• You must establish and manage all employment terms including salary, duties, hours, and benefits
• You are responsible for compliance with local labor laws and regulations
• You assume all liability for the Helper's actions during employment

For Helpers (Workers, Nannies, Cleaners, Cooks, All Round Helpers):

• You must provide accurate, truthful information in your profile
• You are responsible for obtaining necessary visas and work permits
• You must negotiate and agree to employment terms directly with Employers
• You are responsible for fulfilling all contractual obligations with Employers
• You must maintain professional conduct and quality of service

3. Limitation of Liability

Nanny Nook Curacao is NOT liable for any disputes, damages, losses, injuries, or issues arising from:

• Employment relationships established through the Platform
• Helper performance, conduct, or qualifications
• Accidents, injuries, or damages occurring in the workplace
• Payment disputes, salary issues, or contractual disagreements
• Visa issues, deportation, or legal complications
• Theft, property damage, or criminal activities
• Breach of contract by either party
• Misrepresentation of skills, experience, or credentials
• Any other issues arising outside the scope of our Platform services

By using this Platform, you agree to indemnify and hold harmless Nanny Nook Curacao, its owners, employees, and affiliates from any claims, damages, or expenses arising from your use of the Platform or employment relationships formed through it.

4. No Employment Relationship

Nanny Nook Curacao does not employ Helpers. Helpers (including Workers, Nannies, Cleaners, Cooks, and All Round Helpers) listed on the Platform are independent individuals seeking employment. Any employment relationship formed is exclusively between the Employer and the Helper.

We do not:

• Process payroll or handle salary payments
• Provide employment contracts or legal documentation
• Offer insurance, health coverage, or employee benefits
• Handle visa sponsorship or immigration services
• Resolve employment disputes or mediate conflicts

5. Profile Verification

While we may verify certain information provided by Helpers (such as identity documents), this verification is limited and does not constitute:

• A guarantee of Helper qualifications, skills, or experience
• A background check or criminal record verification
• Employment or character references
• Professional certification validation

Employers must conduct their own thorough verification, interviews, and background checks before hiring.

6. Acceptable Use

Users agree to:

• Provide accurate and truthful information
• Use the Platform for its intended purpose only
• Respect the privacy and dignity of all users
• Comply with all applicable laws and regulations
• Not engage in fraudulent, abusive, or illegal activities
• Not misrepresent qualifications, experience, or requirements

We reserve the right to suspend or terminate accounts that violate these terms or engage in inappropriate conduct.

7. Subscription Fees

Employers may subscribe to access Helper contact information. Subscription fees are:

• Non-refundable once purchased
• For Platform access only, not employment guarantees
• Subject to change with notice

Subscription fees do NOT include placement fees, recruitment services, or employment guarantees.

8. Legal Compliance

Both Employers and Helpers are responsible for:

• Complying with local labor laws and regulations
• Ensuring proper work authorization and documentation
• Following employment standards and worker rights
• Adhering to wage, working hours, and benefits requirements
• Obtaining appropriate insurance coverage

Nanny Nook Curacao is not responsible for users' compliance with legal requirements.

9. Disclaimer of Warranties

The Platform is provided "AS IS" without warranties of any kind. We do not guarantee:

• The accuracy or reliability of user-provided information
• Successful employment matches or placements
• Helper quality, performance, or suitability
• Uninterrupted or error-free Platform operation
• Security against unauthorized access or data breaches

10. Governing Law

These Terms of Service are governed by the laws of Curaçao. Any disputes arising from the use of this Platform shall be resolved in accordance with applicable local law.
